  • By accessing or using BeMyHR (“Company,” “we,” “our,” or “us”), including our website, AI-driven resume services, and related platforms (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).

  • If you do not agree, you must immediately discontinue use.

  • BeMyHR reserves the right to modify these Terms at any time without prior notice. Continued use after updates constitutes acceptance of the new Terms.

2. Services Provided & Business Rights

BeMyHR provides an AI-powered resume creation service that includes:

  • AI-generated resumes tailored to user input.

  • Subscription-based access to our platform.

  • Payment processing via third-party providers.

BeMyHR does not guarantee:

  • Job placement, recruitment outcomes, or interview opportunities.

  • Compatibility of resumes with all job application systems.

  • Uninterrupted service access or system uptime.

2.1. Service Modifications & Discontinuation

  • BeMyHR reserves the right to change, suspend, or discontinue services at any time without liability.

  • We may modify pricing, subscription plans, or feature availability at our sole discretion.

  • Users have no right to claim compensation for service changes.

3. User Eligibility & Responsibilities

To use BeMyHR, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction).

  • Use the Services in compliance with applicable laws.

  • Provide accurate, truthful, and complete information.

User Responsibilities:

  • Users may not attempt to reverse-engineer, copy, or misuse BeMyHR’s AI systems.

  • Users assume full responsibility for their resume content and its consequences.

  • Users may not hold BeMyHR liable for any job-related rejections, lost opportunities, or hiring decisions.

4. Account Management & Termination

  • BeMyHR reserves the right to suspend, terminate, or restrict accounts at its sole discretion without prior notice.

  • Users forfeit all access to services upon account termination.

  • Subscription payments are non-refundable, except where required by law.

BeMyHR may terminate accounts for:

  • Providing false or misleading information.

  • Unauthorized access or misuse of AI-generated content.

  • Violation of these Terms or applicable laws.

5. Subscription, Billing & Payment Terms

  • BeMyHR charges subscription fees via credit card payments processed by third-party providers.

  • By subscribing, users authorize automatic recurring payments until cancellation.

  • No refunds are provided for unused subscription periods, except as required by law.

5.1. Subscription Cancellation

  • Users may cancel at any time through account settings.

  • Upon cancellation, access is revoked immediately, and no refunds will be issued for the remaining billing period.

6. Data Use, Retention & Ownership

By using BeMyHR, you grant us a non-exclusive, worldwide, royalty-free license to process your resume data for the purpose of service delivery.

  • BeMyHR owns all AI-generated content and models.

  • User data may be retained for business, legal, and analytical purposes, even after cancellation.

  • BeMyHR has no obligation to return or transfer user data upon termination.

6.1. Data Deletion Policy

  • BeMyHR reserves the right to retain anonymized user data after account closure.

  • Users must request deletion in writing, and requests are granted at BeMyHR’s discretion.

7. Disclaimers & Limitations of Liability

To the fullest extent permitted by law:

  • BeMyHR disclaims all warranties, express or implied.

  • We are not liable for:

    • User reliance on AI-generated content.

    • Loss of income, employment, or business opportunities.

    • Unauthorized access or security breaches.

Maximum Liability:

  • BeMyHR’s total liability shall not exceed the total amount paid by the user in the last three months before a claim.

Users expressly waive the right to claim damages beyond this limit.

8. Indemnification

  • You agree to indemnify and hold BeMyHR harmless from:

    • Any legal claims related to resume content.

    • Data loss, security breaches, or unauthorized access.

    • Employment rejections based on AI-generated content.

  • BeMyHR is not responsible for third-party interactions, including recruiter decisions.

9. Governing Law & Legal Disputes

  • These Terms are governed by the laws of the Province of Alberta and Canada.

  • Any legal disputes must be resolved exclusively in Alberta courts.

  • Users waive the right to participate in class-action lawsuits.

  • Disputes must be resolved through individual arbitration before pursuing legal action.

10. Changes to Terms

  • BeMyHR may update these Terms at any time without user notification.

  • Continued use after updates constitutes acceptance of revised Terms.
